BJJ Battalion Waiver,
Acknowledgement & Release
In signing this document you are waiving the right to bring a court action to recover compensation or obtain and other remedy for: personal injuries, damage to property, loss of property, accident of any kind, death, arising out of your use of BJJ Battalion.
This includes BJJ Battalion Facilities, equipment, your participation in classes, or activities sponsored by BJJ Battalion (including but not limited to Tournaments, seminars, clinics, martials art classes, and special events) whether supervised or unsupervised.
You must be 18 years or older to sign this acknowledgement and Release, otherwise a parent or guardian must sign on your behalf.
ACKNOWLEDGEMENT and RELEASE
BJJ Battalion operates facilities (“GYM”) and equipment, and may provide classes or activities whether supervise or unsupervised by BJJ Battalion agents (“GYM Activities”).
AND WHEREAS an essential condition for BJJ BATTALION permitting me to use its facilities and/or participate in GYM activities, I, my personal representatives, assign, and heirs:

Acknowledge, agree and represent that I understand the nature of the GYM and GYM activities that I am in good health and in proper physical condition to use the GYM and participate in GYM activities.

I fully understand that:

The GYM and GYM activities may involve serious risk and dangers of serious body injury.

These risks may be caused by my own action, the actions or inactions of other GYM members.

There may be other special or unusual risks associated with the GYM or GYM activities, including social or economic losses and
I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITIES FOR ALL LOSSES, COSTS AND DAMAGES I MAY INCUR AS A RESULT OF MY USE OF THE OR MY PARTICIPATION IN THE GYM ACTIVITIES (NOW AND IN THE FUTURE).

AGREE AND WARRANT that I will examine and inspect all GYM equipment and each GYM activity in which I take part and that, if I observe and condition which I consider to be hazardous or dangerous, I will notify the proper authority in charge of the GYM or GYM Activities, as the contest requires to use such equipment or take a part in such GYM Activities until the condition has been corrected to satisfaction.

HEREBY RELEASE, discharge and covenant not to sue BJJ BATTALION its officers, directors, shareholders, employees, volunteers, instructors, participants in GYM activities, and the GYM users for all liability, claims, causes of action, demands, losses or damages caused or alleged to have been caused, by in whole or in part by my use of the GY, my participation in GYM activities or negligence of the releases or otherwise. I fully agree that if despite executing this acknowledgement and release I oer anyone on my behalf, makes a claim against any of the releases, from any litigation, expense, solicitor fee, loss, liability, damage or cost which may be incurred as a result of such claim.

CHOICE OF LAW AND ATTORNMENT - This acknowledgement and release shall be governed by and constructed in accordance with the laws of the province of Ontario and the laws of Canada applicable within.
I agree that the courts of the province of Ontario will have exclusive jurisdiction to determine all disputes and claims arising between the parties.

SUCCESSOR AND ASSIGNS -This acknowledgement and release shall be binding upon myself, my personal representatives, assigns and heirs and shall endure the benefit of BJJ Battalion, and its respective heir, executors, administrators, directors, successors, assigns and legal representatives.

I understand and agree that as a club member or visitor I may be photographed, videotaped, contacted by e-mail or other means, or have my likeness by other means and used for commercial purpose including but not limited to marketing, instructional procedures, and internet applications.
Rules & Participation
The Member hereby agrees to abide by all posted safety guidelines and regulations while using the Company’s facilities and equipment. Additionally, the Member agrees to dress and conduct themselves in a manner deemed appropriate for the fitness facility.​
The Member shall not consume drugs, alcohol, or tobacco products on the Company’s property.
At BJJ Battalion we do not tolerate any violence between children. We want everyone to have fun and stay safe. Children under 10 years old will be put in a corner of the dojo for 5 minutes if they are misbehaving such as beating, punching or kicking other kids or yelling and trying to cause havoc. After 5 min, if the behavior of this kid has not changed, we will ask the parents to leave and wait one year before coming back with the child. If the parents are absent during the class, we will put the kid who is misbehaving in the changing room, lights on, door closed but not locked, for 5 minutes and then try to see if his behavior gets better. Then if possible, this child will then wait in the corner until the parents come back. We will ask the parents to wait one year before coming back with the child.

Membership Cancellation
This membership may be canceled by providing written notice, 14 days minimum prior to the next payment date, by email to bjjbattalion@gmail.com.
I have read this acknowledgement and release fully and understand its terms, and understand that I have given up substantial rights by signing it, and have it signed freely without any inducement or assistance of any nature and intend to be irrevocable and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this acknowledgement and release is held to be invalid, the balance of the acknowledgement and release chall continue in full force and effect.
